The National Transportation Safety Board said Thursday that Tesla released information about the investigation before it was confirmed. And even though the stock has recovered (ever so slightly), Tesla's market cap is still some 23 per cent lower than it was last September.

The company said it released information to correct "misleading" claims being made about Autopilot creating safety problems.

Then Tesla - a company led by a man who closely monitors the media and his public image - asserted that the safety board was "more concerned with press headlines than actually promoting safety".

While rare, the NTSB has revoked party status in other investigations. Zacks Investment Research downgraded shares of Tesla from a hold rating to a sell rating in a research note on Tuesday, February 13th.

Tesla argues that its Greenwich gallery was merely educating consumers about Tesla vehicles and telling them how they could lawfully purchase the vehicles in other states.

A week after the accident, Tesla announced that "the driver had received several visual and one audible hands-on warning earlier in the drive and the driver's hands were not detected on the wheel for six seconds prior to the collision". Tesla indicated that it withdrew from the agreement with the federal accident investigators, counter to the NTSB's indication that it had thrown the company out, because it clashed with restrictions on what Tesla could share publicly about Autopilot. For this they take help from the indicator known as Relative Strength Index (RSI), a momentum indicator that expresses a relative assessment of the strength of a security's recent price performance. "If anything, the NTSB is shining a spotlight on Tesla due to their innovation", Friedman said.

The driver died after crashing into a highway barrier. It also says automatic emergency braking "is not created to avoid a collision and is not a substitute for maintaining a safe traveling distance" from other vehicles. The NTSB called the system "a privilege [that] allows the sharing of investigative information with all parties that agree to the terms of the party agreement during the early fact-gathering phase of an investigation".
