Trump Administration Moves to Exclude Transgender People from Civil Rights Protections

In their boldest move against LGBTQ rights, the Trump administration is considering an exceedingly limited definition of sex that would likely erase any and all transgender rights and protections.

The Times report said the Department of Health and Human Services is working to define sex under Title IX as exclusively male or female at birth, with no room for change. "The sex listed on a person's birth certificate, as originally issued, shall constitute definitive proof of a person's sex unless rebutted by reliable genetic evidence".

The move essentially would do away with protections afforded to around 1.4 million Americans who identify as transgender.

The definition could not be changed legally and any disputes would require genetic testing, according to the report.

"Transgender people are frightened", said Sarah Warbelow, legal director of the Human Rights Campaign, which presses for the rights of lesbian, gay, bisexual and transgender people.

Trans and non-binary people and their loved ones have been tweeting in response to the Trump administrations ugly proposal, proving that no matter what, they will not be erased, and such human rights atrocities won't go down without a fight.

The Department of Health and Human Services has undertaken an effort across several government departments to establish a legal definition of sex under Title IX, the federal civil rights law that bans discrimination on the basis of sex, the Times said, citing a government memo that it obtained. The proposal could formally be presented to the Justice Department by the end of the year, sources told the Times.

The administration has also prohibited officials at the Centers for Disease Control and Prevention from using the word "transgender" in official budget documents, as The Washington Post reported in December, and HHS has archived a page that outlined services available for LGBT people.

Instead, it would define gender exclusively on the genitalia people are born with.

"A federal court has blocked HHS's rule on gender identity and termination of pregnancy as contrary to law and infringing the rights of healthcare providers across the country", Severino's statement said.
